The Public Procurement Act 28 of 2024 is on the statute book, but the South African Government’s Act page lists commencement as ‘to be proclaimed’. National Treasury’s August 2024 statement said the provisions would come into operation through a proclamation in the Gazette.
Treasury said the procurement framework then in place would remain until the relevant provisions of the Act and accompanying regulations took effect. The Act’s enactment and its commencement are separate legal events.
This status note reflects the official government and Treasury pages reviewed on 23 September 2026. Any later proclamation or legislation would change the position and should be checked in the Gazette.
What it means
Procurement teams should cite the commencement proclamation and final regulations when they are published. A draft regulation or an Act’s publication alone does not prove that a new provision is in force.
